I expect the Australian Family Division resembles that in England, where decisions are 10% jurisprudence and 90% "muh feelz". It has given us Baroness 'Spider Woman' Hale , with her remarkable ability to discard centuries of jurisprudence in an ultimately failed attempt to block a democratic decision of which she disapproved.

This is the sad part but true around the world, and very notable in not only the UK but the same method is used in the EU and the UN:

"The sad truth is, they don’t need rigour. They can walk this into Parliament, get a room full of MPs nodding along, and watch it become the basis for policy."

So much of what I do is fighting against this kind of crap internationally. Reports that claim something and cite studies that either show the exact opposite, or are so flawed they should be ignored. And the sad part is that emotive commentary - especially when it purports to be about helping women - beats reason and fact every time. By the time we get out a detailed tear-down of a document, nobody cares and the lies have gone around the world and are already forming laws and policies.

For some reason, this isn't a crime. Near zero governance and ethics. Such judges and attorneys: protected species.

Carol, from your response to this article it's clear you are a supporting mother. I express gratitude on behalf of all fathers going through this. It is extremely debilitating to "lose" a child in this terrible way. Without exaggeration, it can be likened to a funeral.

Stay close to your son and maintain the support he so badly needs now and into the future.

We don't "lose" children in this way. They're kidnapped by the divorce industrial complex. They're racketeers and they get their leverage through the children. If they were protecting the institution of marriage, they'd remove the children from the spouse wishing to abrogate their vows. However they know that if they do this, that spouse (always the woman) will change her mind and the industry lose all that potential revenue. So they invariably steal them from the spouse wishing to stay married. It's a state-sanctioned kidnapping & extortion racket, end of story. Let's not play their game and dress this criminality up in euphemisms.

It might surprise you to know that it’s not always mothers/women wishing to abrogate marriage. Irrespective of the gender of departing spouse, the issues between couples should not be carried into the children’s minds and lives. Nevertheless it happens and some parents use the law gender bias along with children as a weapon against their partner. Damage is done to the next generation.

Where children are involved, it's almost always the woman who wants out. Otherwise 90% is the accepted figure. The term "gender" is a feminist invention. We have a male and female sex. Man or woman, if there's no fault, then you have a derisory process.

I am the mother of a devastated son who has been going through this for the past 2 years. So many $$$ later and still no access to his son or even me as grandmother. My son labelled in 2 court cases as a violent partner, however proven not!! Now watching my son, now with mental health concerns, very sad. Not to mention the trauma this must cause the child!

Carol, there have been recent moves by the Government to disallow grandparents representation in the FC for access to their grandkids, but I am not sure at what stage this has progressed to. The legislation for this proposal reeks of ill intent.

If the status quo remains the same then you are able as grandparents to apply for some form of visitation independently of your son's access situation. I do know of a situation where such limited access (it was meals at Red Rooster) and agreed to. No doubt the mother and her "connections" were close by to observe. Maybe bring it up with your son's solicitor, and if that legal rep cannot get a meeting with you and the grandkids then such a refusal could point to additional alienation for that purpose alone. Try to include photos (particularly spontaneous or non-posed) of yourselves with the grandchildren, probably without your son pictured, and include any positive communication/texts you may have had with your son's ex over the years, together with informal and formal arrangements you had in minding the grandkids that could also include overnight stays, school pick ups/drop offs etc.

Children became the fianancial assets, as the parent (usually the mother) who had the greater amount of custody were awarded a greater share of the assests,

An allegation of domestic violence against the father is very effective in getting the courts to award custody to the mother, even when she is the instigator.

The most dangerous place for a child in Australian society is to live with that childs biological mother and non biologically related males.

What is significant is that the AIHW stopped publishing data that identified the primary perpetrator of child abuse.

the book's claim that in the year after divorce women's standard of living decreased by

a whopping 73 percent while men enjoyed an increase of 43 percent caught the attention of pundits, legislators, and judges.

This statistic has become one of the philosophical bases for deciding child custody and property division in divorce cases. It has also altered public perceptions of men, women, and divorce. It was cited hundreds of times in news stories, scholarly studies, and law review articles last year, and was regarded so clearly as holy writ that President Clinton cited it too in his budget proposal this year as part of his attack on deadbeat dads.

The only problem with this statistic, in fact, is that it wrong.

Bettina, I agree with everything you say in your newsletter. The injustice and violence against men is incredibly hidden by mainstream media. A typical recent incident, which was basically only shown on Sky News re Grace Tame’s latest quest for the limelight. Portrayed as the victim of sexual abuse, when she was in reality more guilty of abuse than her victim, the teacher. He did jail time and she was bestowed with Australian of the Year!!!

Thank you for your continued battle - Exposing hypocrisy and your support of the underdog - human male.

Fantastic article Bettina.

Sadly the family court (Federal and Family Court of Australia) here is totally out of control at the moment- it is a massive bureaucracy drenched in misandrist ideology, stacked to the gills with female Registrars and Deputy Registrars (absolutely ridiculous imbalance, over 85% female) who must subscribe to the ideology to be recruited and to get ahead.

As a result it is insanely biased against men. You pointed out how it has removed the assumption that children should spend time with both parents, a disgrace. There is also a culture to “believe all women” and an outrageous assumption that all men are predatory in nature.

Unfortunately, on the current trajectory, there is NO way it will change - in fact and as you correctly pointed out, things are likely to get worse because of the pathetic weakness and cowardice of our politicians.

The only way to fix this is to vote in a party that seeks to overhaul the entire family law system, and to restore sanity.

I never thought I would say it, but voting for One Nation appears to be the only chance we have. Yes they may end up to be duds, yes they may end up to be frauds, but end of day they’re the only bet Australians have to end the insanity.

Agreed on Pauline Hanson's and One Nation's outstanding record with these issues, in contrast to the craven cowardice (which amounts to "lying") of the Labor/LNP duopoly.

I particularly recall Hanson getting agreement from ScoMo to conduct an inquiry into family court which included, at about point #4, the suggestion that dv allegations may sometimes, just occasionally, be exploited in custody disputes - for which she got widespread abuse and ridicule.

ScoMo only agreed to the enquiry as a political deal, and distanced himself from it like from bad smell and when the report was produced he shelved it.

How do these people sleep at night?

I guess that those with sons are keeping their fingers crossed that their own son will be one of the lucky ones in the Russian Roulette of dating and marriage, and probably also hoping that if he gets done-over that he won't be an embarrassment to their career.

Things have changed a lot since Morrison was PM, the liberals are now forced to support One Nations policies on things such as immigration and net zero madness, that’s where the votes are now and the Libs need votes like never before if the polls are anything to go by . Maybe with the right lobbying they would also support One Nation on the Family Court issue as well.

The new leader Angus Taylor is slowly coming around , trying to save face for his party and at the same time change the entrenched left leaning policies which have failed the party so badly , there is still hope.

Agreed. It's a good start that they are supporting ON on immigration and net zero.

The real test will come with men's issues. We can bet that there will be utter silence until they've accepted that silence is seen as complicity with the status quo, and that the feminist juggernaut (MSM, academia, the dv industry etc.) will go into attack-beast mode at the slightest mention of men's issues, but the numbers tell them that silence is no longer an option. Not holding my breath.

I agree. One Nation is the only party likely to achieve change in this vital area. Pauline has been heroic, speaking out for years about false allegations. She is one of the very few parliamentarians willing to do so.

Yep been voting for One Nation ever since I seen Pauline Hanson stand up for equality not just for men but an equal Rights, Access, Participation and Equity for all the 4 pillars of a healthy society Labor has failed all Australians just to create jobs and money making industries for the top heavies. This is why we have so much youth crime and domestic violence issues. The Labortion Party. I read Patrick Parkinson's linked in post.
